...As Supreme Court Rules  On Amaechi's Tenure Next Week

 

Omehia's long standing suit at the Appeal Court challenging the tenure of Governor Amaechi may be resurrected soon, and the plan to resurrect it has rekindled the former governor's hope that justice might still be obtained.

By the wordings of that suit, Amaechi should have vacated office since May 28, 2011.

It was actually one Chief Cyprian Chukwu who first raised the issue when he approached a Federal High Court, Abuja to revisit the suit: Amaechi Vs INEC (2008) praying that the governor should be made to leave office on May 28, 2011 to pave way for a new election.

Although, it was alleged that Chukwu was sponsored by the in incumbent administration so that Amaechi would benefit from the alleged deal between the incumbent PDP governors who were eligible for second term, the Federal High, nevertheless gave judgement on the matter.

Delivering his judgement then, the court president over by Justice Abdul Kafarati held that the period held in office by Sir Celestine Omehia formed part of Amaechi's four year tenure and added that it was wrong in law for Governor Amaechi to stay in office a day longer than May 28, 2011.

The court further argued that the election of April 14, 2007 under the PDP platform was never nullified by any court, stressing that what the Supreme Court did was only to ask Omehia to vacate office for the rightful occupant and never cancelled the election or ordered for a fresh one.

Sir Omehia however filed an appeal against the high court's ruling, insisting that Chukwu's suit which verdict was delivered by the lower court commenced by originating summons for the interpretation of the Supreme Court's decision in Amaechi versus INEC (2008).

Omehia in the suit in which Chief Cyprian Chukwu, Amaechi and the PDP are respondents had asked the court to jettison the declaration and orders made by the Federal High Court, Abuja in favour of Chief Chukwu for lack of jurisdiction.

With the case coming up this May at the Supreme Court, hope for justice for Sir Omehia, the governorship candidate of the APGA in the 2007 election, may not have been lost, afterall.###
