Alleged Breach Of Contract: Court Adjourns To July 20

…Relists Case

A Port-Harcourt High Court has adjourned to July 20 for pretrial conference over the case of alleged breach in business relations between two parties.

The court presided by Honourable Justice M.O. Opara adjourned the case after claimants’ counsel, Barrister Kelvin Onyeabor, made application for the case to be relisted in the cause list after it was previously struck out in earlier sitting for lack of diligent prosecution.

The claimants, Judy Best Ideal Stores Ltd and others, alleged that the defendant, Mr Ezekiel Obinna, failed in a transaction agreement to pay for drinks supplied to his chain of clubs and had requested payment.

However the defendant said that he paid for the drinks supplied to his chain of clubs.

The two parties have been in business for more than ten years, counsel for the defence, Prince Dike, said.

The claimants are expected to call witnesses over the case after the pretrial conference.

The case was transferred from the undefended list to general cause list.

A case would be on undefended list when there would be no defence over the case.

However, the defence counsel at the last hearing put up defence over the case and the court decided to transfer it to the general cause list.

The case was previously struck out for lack of diligent prosecution.

On Tuesday, the counsel to the claimants made an application for the case to be relisted in the cause list.

The claimants’ counsel was not opposed by the defence.

In her ruling, the presiding judge relisted the case in the general cause list and adjourned for pretrial conference fixed for July 20.
